Administrative Changes to US Patent Law – September 2011

Changes to the US Patent Act include moving to the “first-to-file” system (vs. the previous “first-to-invent”), and introduce new cost-reduction opportunities for micro-entities.
A 15-percent surcharge will be added to all patent-related fees, including patent maintenance fees. We recommend that you pay any upcoming patent fees prior to September 26, 2011, particularly issue fees and maintenance fees.

IP Protection in China and India – not what one might expect!

It is disappointing to realize, that very few Israelis express interest in protecting their IP in India and China. As it turns out, Israeli prejudice towards SE society leads to misconceptions in the IP protection domain. These misconceptions have a poor effect on strategic marketing decisions in the field of IP protection.

Excerpts from a summary of judgment in a trial in which Dr. Goldraich was an expert witness

From the summary of judgement:
“I agree with this conclusion of the expert, Dr. Goldraich… In her statement of opinion, the expert, who has impressed me with her proficiency and great professional integrity, reviewed the patents’ prior art, including the relevant patent and patent applications, as well as the names of products and catalogues of companies that distribute kits for non- destructive opening of apertures, part of which already existed in the market before the patent application was submitted for registration.”

Patenting Military Technology — Is It Possible?

Where military interests are concerned, the motives for technological development and its funding have to do with national security interests, to outpace enemy states in the arms race. Countries that have invested in military technology clearly have no interest in publishing their data or in providing a specification that “a person skilled in the same technological area of invention would be able to make and use,” as per patent instructions. On the other hand, when these technological developments are intended for profit, the commercial motive outweighs the security one.
